Prices, Fees and Special Charges

Prices are subject to change without notice. Written quotations are valid for 30 days. The order is confirmed with Order Acknowledgment. Texmate has the right to revise the price if pricing mistakes are found. Customers in the state of California will have sales taxes added unless a signed sales tax exemption certificate is on file at Texmate. For orders below $500 (distributors) or $250 (all other customers), a small order processing fee of $25 will be charged. Rush Manufacturing options are available at extra charge (stated on the quote sheet) upon availability. Shipping and any special handling charges may be added. For the drop-ship service, a $25 fee will be charged. For FedEx shipments, a $10 pickup fee will be added. Standard COC is free of charge, the fee for custom COC is $50.

Payment Terms

Standard payment methods are Credit Card (carries a 3% processing fee), ACH, Wire Transfer, or Check paid in advance. International orders will only be accepted with Wire Transfer in advance. We offer Payment NET 30 Days (payment to be received within 30 days) for approved accounts with a minimum past purchase volume of $10K within the past 12 months. Interest charge will be applied to overdue accounts at 0.1% per day and will be reinvoiced at full price if discount was applied to the invoice.

Order Fulfilment and Cancellation

Orders placed may be canceled by the customer during or after fulfillment, upon paying a service charge equivalent to, or exceeding 25% of the order total. This amount is determined by the expenses and commitments borne by Texmate, Inc. Texmate cannot be held liable for order delays or cancellation due to manmade or natural disasters. All meter faceplates must have a Texmate logo. Faceplates with custom scales and descriptors can only be created and produced exclusively by Texmate. The customer owns the rights to have Texmate reproduce them with the requested quantity.

Shipment

• All products are shipped Free On Board at Carlsbad via our standard shipping carriers UPS (national) or DHL Express (international). FedEx shipment is possible on request ($10 pickup-fee). No third-party pickup arrangements are permitted.
• In all cases, title and responsibility pass to the consignee upon shipment.
• Claims for damaged or lost shipments should be filed promptly by consignee directly with the carrier.
• Packaging is in commercial containers suitable for ensuring safe delivery under normal shipping conditions.
• Claims for short shipments or other discrepancies will not be considered unless Texmate is advised within 48 hours of receipt of the shipment.
• Texmate reserves the right to make shipments up to 15 days prior to the scheduled shipment date.
• On overdue accounts, shipments will be held without notice.

Warranty, Return of Goods and Repair

Texmate warrants for a period of one year from date of shipment. Products under its brand are free from defects in material and workmanship under normal use and service. Texmate’s warranty does not cover defects caused by improper use of the items (contrary to the stated purpose and scope of use), external mechanical force, overvoltage, electromagnetic field, moisture, unauthorized repairs, and any other external factors.

Texmate offers a 90-day Product Return Option for the standard Texmate products and standard accessories. The Restocking Fee is 25% of the purchasing price. The return option does not apply to any non-standard, custom-built orders, custom-modified products, discontinued models, large quantity orders, any service fees charged or third-party products.

Texmate Inc. offers the following return and repair options:

  1. The standard Texmate product you purchased is within 90 days of the invoice date and it has not been used, misused, abused, altered (parts changed, Texmate logo removed), or physically damaged: After evaluation of this product, we will offer a warranty repair free of charge or accept a product return with a restocking fee of 25% of the purchasing price.
  2. The Texmate product you purchased is within 12 months of the invoice date and it has not been misused, abused, altered (parts changed, Texmate logo removed), or physically damaged: After diagnosis of this product, we will offer a warranty repair free of charge.
  3. The Texmate product you purchased is more than 12 months past invoice date OR it has been either misused, abused, altered, or physically damaged: After diagnosis of the product ($40 fee), we will quote you a repair estimate. If you decide to repair the defective unit, the diagnosis fee will be used as credit towards the repair cost.

If a customer experiences a Texmate product failure, the character and cause of the damage should be identified as precisely as possible. For all warranty requests, the original invoice number or serial number (printed on the meter label) has to be provided by the customer.

If our Technical Support cannot resolve the issue, please submit your RMA Request online (www.texmate.com/rma). We will inform you about the next steps.

Information or items requested in order to process the RMA need to be provided promptly. The customer pays for the shipment to Texmate. If it is determined that the products are under warranty repair, Texmate pays for the return shipment to the customer. All RMA will be closed within 30 days of the last correspondence. After closing, Texmate waives responsibility for all material not claimed by the sender.

Users Responsibility

We are pleased to offer suggestions on the use of our various products either by way of printed matter or through direct contact with our sales/application engineering staff. However, since we have no control over the use of our products once they are shipped, NO WARRANTY WHETHER OF MERCHANTABILITY, FITNESS FOR PURPOSE, OR OTHERWISE is made beyond the repair, replacement, or refund of purchase price at the sole discretion of Texmate. Users shall determine the suitability of the product for the intended application before using, and the users assume all risk and liability whatsoever in connection therewith, regardless of any of our suggestions or statements as to application or construction. In no event shall Texmate's liability, in law or otherwise, be in excess of the purchase price of the product. Texmate cannot assume responsibility for any circuitry described. No circuit patent or software licenses are implied. Texmate reserves the right to change circuitry, operating software, specifications, and prices without notice at any time.
